Subscription Terms & Conditions

1. Subscriptions to this site are available to Licensed Motor Dealers only. Each applicant warrants that it holds a current Motor Dealers Licence.
2.The "Basic Plan" is for 12 months or 1,000 searches, whichever occurs first. The "Low User Plan" is for 12 months or 400 searches, whichever occurs first. The "High User Plan" is for 12 months or 2,000 searches, whichever occurs first. A search is registered each time the "search" button is activated. All fees are payable in advance and are non-refundable.
3. Each subscription is personal to the subscriber and its employees only and cannot be used by, nor re-sold to, a third party. dealersonline.com will provide the subscriber with a username and password to access the site. The subscriber is responsible for all usage by that username and password.
4. This site lists vehicles for sale by various vendors. Any contract for the sale and purchase of a listed vehicle is between the subscriber and the vendor that listed the vehicle and is not a contract to which dealersonline.com is a party. Any dispute relating to a sale or purchase of a vehicle is a dispute between the vendor and the purchaser, and the subscriber releases dealersonline.com from all claims, demands and damages (including consequential and punitive damages) of every kind and every nature arising out of any such dispute.
5. dealersonline.com takes no responsibility for the accuracy or currency of listings.
6. dealersonline.com makes no representation in relation to, and is not responsible for, the condition, merchantability, safety, description or ownership of the vehicles listed on the site or the truth or accuracy of the listing. Each subscriber must make its own investigations in relation to a vehicle before purchasing from the dealer listing it.
7. Subscribers must not attempt to monitor or copy the web pages of dealersonline.com and must not use any device, routine or software to interfere or attempt to interfere with the site or with any listing.
8. Subscribers must not take any action that imposes an unreasonable or disproportionately large load on the dealersonline.com site.
9. dealersonline.com takes no responsibility for failure of the system - e.g. hosting, communications breakdowns, site overload etc. dealersonline.com does not guarantee or accept responsibility for continuous, uninterrupted or secure access to its services or site.
10. The subscription agreement does not constitute any agency arrangement between dealersonline.com and the subscriber.
11. dealersonline.com has the right to terminate a subscription in the event that it considers that the subscriber is in breach of the Terms and Conditions of Subscription. If that occurs, the subscriber forfeits the unused portion of its subscription fee.
12. dealersonline.com retains ownership of all intellectual property rights in relation to its site and the information contained in it and the services provided by it.
13. dealersonline.com is not liable for any lost profits or any damages (actual, consequential, punitive, special or otherwise) however arising (including by negligence) arising out of or in connection with this subscription. To the fullest extent permitted by law, the liability of dealeronline.com and its suppliers to the subscriber or to any third party in any circumstances is limited to the greater of:
a. The amount of subscription fees that the subscriber has paid to dealersonline.com in the past 12 months prior to the act or omission giving rise to the liability; and
b. $100.00
14. dealersonline.com has the right to amend these Terms and Conditions of Subscription at any time by posting on the web site. Once posted, the amendments take effect and are deemed to be incorporated into these terms and Conditions as and from the time of posting.
15. This subscription agreement is governed by the laws of the State of Victoria and the subscriber irrevocably submits to the non-exclusive jurisdiction of the courts of that State.
